Due to the current climate, and the national skills shortage it is imperative that proper professional advice is sought, and that any building professional employed should hold relevant qualifications. Surprisingly it is not a legal requirement to have any qualifications to act as a party wall surveyor?

Once an appointment has been given to a party wall surveyor, whether this be by a signed letter of appointment or even an email instruction, you are waiving your legal rights, and giving that person your full authority to act for you. That person, then instructed under section 10 of the legislation has the legal rights to act on your behalf, including setting Fees.

Therefore, the importance of using only “qualified” building professionals in my opinion, should be considered as a top priority. I would highly recommend before giving anybody authority to act, that their credentials are checked fully in terms of academic qualifications including professional affiliations and construction related experience.

I would therefore encourage all persons requiring party wall advice and services to explore all surveyors, to obtain a fair costing, and more importantly check the credentials and qualifications of any surveyors before accepting any instruction.
